Terms of Service

1. Who Can Use PoolStamp

PoolStamp is designed for pool service professionals. To use it, you need to be at least 18 years old, have legal capacity to enter a contract, and not be prohibited from using software services under U.S. or other applicable law. If you’re creating an account for a business, you’re confirming that you have authority to agree to these Terms on that business’s behalf.

2. Accounts

• You must provide accurate, current information when creating an account, and keep it up to date.
• You are responsible for all activity on your account and for safeguarding your password.
• Notify us immediately at info@poolstamp.com if you suspect unauthorized access.
• One person/business per account unless we agree otherwise in writing.

3. Your Customers’ Data

You retain ownership of the records you upload — customer details, visit logs, photos, chemical readings, invoices, and so on (“End Customer Data”). You grant PoolStamp a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, back up, analyze, and retain End Customer Data as reasonably necessary to provide, secure, support, measure, and improve the Service; support trial accounts and account recovery; maintain audit trails; comply with law; and create aggregated or de-identified operational insights.

PoolStamp will not sell End Customer Data, share it with advertising networks, or use it to train third-party AI models. If we later offer benchmarking, data-cooperative, or market-insight products, we will design them around aggregation, de-identification, access controls, and deletion rights, and we will update these Terms and the Privacy Policy before using identifiable End Customer Data for any materially new purpose.

You represent and warrant that you have all rights and consents necessary to upload End Customer Data and that the data does not violate any law or third-party rights. We act as a processor with respect to End Customer Data; you are the controller.

4. Acceptable Use

PoolStamp is built for running a legitimate pool service operation. Don’t use it to send unsolicited or deceptive messages, probe for vulnerabilities, reverse-engineer our systems, build something that competes with us using our own infrastructure, resell access, or misrepresent who you are. Accounts that cross these lines can be closed immediately, without a refund.

5. Fees and Billing

PoolStamp offers free and paid plans. Pricing for paid plans is shown at poolstamp.com/#pricing. Paid plans renew automatically until canceled. Fees are non-refundable except where required by law. You authorize us to charge your payment method for all fees and applicable taxes. If a charge fails, we may suspend access until payment is made.

Free trial: New accounts receive a 14-day free trial. If you provided a payment method at signup, we will email you a reminder at least 3 days before the trial ends and the first charge is made; you may cancel at any time before then at no cost. We will provide at least 30 days’ advance notice before introducing fees that affect your account.

6. Communications

If you use PoolStamp’s SMS or email features to contact your customers, you represent that each recipient has given any consent required by TCPA, CAN-SPAM, CASL, carrier rules, and other applicable law before messages are sent. PoolStamp service texts are intended for transactional pool-service updates, are optional, and are not a condition of any purchase or service. You are responsible for accurate sender identity, lawful message content, and maintaining verifiable consent and opt-out records. Recipients must be able to stop texts at any time by replying STOP, request help information by replying HELP, and resume or confirm service texts with START where supported. We do not sell, rent, or share mobile opt-in information, consent records, or phone numbers with third parties or affiliates for their own marketing or promotional purposes. Message frequency varies and message and data rates may apply. We may suspend messaging features immediately if we receive abuse complaints, carrier compliance issues, or reason to believe consent records are inaccurate or missing.

7. Third-Party Services

The Service relies on third-party providers including Render, Cloudflare R2, Postmark, Twilio, Mapbox, and Stripe. Your use of the Service is also subject to their terms. We are not responsible for outages or actions of third-party providers.

8. Intellectual Property

PoolStamp — the software, the brand, the visual design, and the documentation — belongs to us or the people who licensed it to us. Using the service doesn’t transfer ownership of any of that to you. What you’re getting is a limited, personal, non-transferable right to use PoolStamp for your pool service business. We keep everything else.

9. Service Availability

We work to keep the Service available but do not guarantee uninterrupted access. We may add, change, suspend, or discontinue features at any time. If a change materially reduces functionality of a paid plan, we will give reasonable advance notice and, where required, a pro-rated refund.

10. Suspension and Termination

By you: Delete your account directly within the PoolStamp app (Settings → Account → Delete Account) or by emailing info@poolstamp.com. Deleting your account cancels any active paid subscription; you remain responsible for fees accrued through the deletion date. By us: We may suspend or terminate your account immediately if you breach these Terms, continued service would expose us to legal liability, or for non-payment. After termination you may export your data for up to 30 days. After that window, production access may be disabled and records may be deleted, archived, or retained in limited dormant storage as described in the Privacy Policy, unless deletion is required by law or requested through an available privacy process.

11. Disclaimers

PoolStamp is a field operations tool — it helps you capture, organize, and send records from service visits. It is not a safety system, a chemistry advisor, or a compliance guide. When it comes to chemical readings, equipment conditions, health codes, and anything else that affects real-world safety, your professional judgment governs. Nothing in the app replaces that.

We work hard to keep PoolStamp reliable, but we make no guarantees about uninterrupted uptime, error-free operation, or fitness for any specific use case. You use the service as it is and as it is available.

12. Limitation of Liability

If something goes wrong and you have a claim against PoolStamp, our liability is capped at the greater of: (a) the total fees you paid us in the twelve months before the claim arose, or (b) $100. We’re not responsible for lost profits, downstream business losses, or harm caused by circumstances outside our direct control. These limits apply to the full extent the law where you’re based allows.

13. Indemnification

If a third party brings a claim against PoolStamp that arises from your data, your use of the service, or something you did that violated these Terms or the law, you agree to take responsibility for that claim — including covering our reasonable legal costs in defending against it.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at poolstamp.com/terms. If a change is material, we will give Operators reasonable advance notice. Continued use after the effective date constitutes acceptance.

16. Miscellaneous

These Terms, together with the Privacy Policy, make up the complete agreement between you and PoolStamp. If a court finds a particular section unenforceable, that section can be removed or modified while everything else stays in place. Your rights under these Terms are personal to you and can’t be transferred to someone else. We can transfer our obligations in connection with a merger, acquisition, or asset sale.
